So I have another boundary construction dilemma. The golden rules are holding original corners before bearings and distances. I'm working on constructing a school boundary, it was platted, and dedicated 15' cutback to the city. All the corners set for the cutback was found.
However, the surveyor who filed the plat didn't use the city monuments to construct the right-of-way line, so his right-of-way is 2' off and the cutback is now 17x17 instead of 15x15.
I already figure out the right-of-way of the street, but I have some doubt on how to do the cut-back. I say all the corners for the cutback are original, so that what should be where the cut-back is, which is 17x17. Another idea is that the plat says cut-back is 15x15, so we should set new corners for the cut-back, since that what the intention is. However, I believe that the intention is what the surveyor set on the ground, doesn't matter if he/she miscalculated the senior line.
However, what if the right-of-way is miscalculated so that the cut-back now is 10x10, do I still hold the original corners? Now the intention 15x15 would have to apply, because it is the city land.
